What the percentages do not cover

  • ORS 116.173(3)(b) adds 1% of property outside the court’s jurisdiction that is still reportable for Oregon or federal estate tax, excluding life insurance proceeds.
  • Under ORS 116.183 the personal representative can also ask the court for further compensation for extraordinary and unusual services.
  • Oregon’s small estate affidavit reaches estates of up to $275,000 in total, so many Oregon estates never run this schedule at all.
