What the percentages do not cover
- R.C. 2113.35 adds 1% of the value of real property that is not sold.
- It adds a further 1% of the value of property that is not subject to administration but would have counted for Ohio estate tax purposes as the tax stood on 31 December 2012, excluding joint and survivorship property.
- Ohio attorney fees are not in this statute. They come from each county probate court’s local rule.
An executor does not have to take the fee. Family executors often waive it, and in Ohio a waiver has to be handled before the final accounting rather than after. ProbateCalculator.org is not a law firm and this page is general information, not legal advice.
